TERMS & CONDITIONS OF SALE
By participating in our auction, you agree that you have read, understand, and agree to the following terms of use, policies, and conditions of sale.
All property is sold "AS IS". All sales are final. No returns.
Sales Tax.
All purchases are subject to the New York State sales tax of 8.875% unless the purchaser possesses a valid New York sales tax exemption certificate or resale number and registers that number with our company or has purchases shipped out of state.
Oversea Duty.
The responsibility of import duty or other extra oversea custom charges goes to the international bidder.
Bidding and Buying.
Users who bid on an item are required to complete the transaction. A bid is a legally binding agreement to complete a sale. Successful buyers who fail to complete a transaction may be blocked for our future sales offered on the site. At our discretion, bidders may be required to post a deposit or submit credit card information in order to participate in our auction. We reserve the right to charge a deposit at the time of registration prior to bidding on any lots. We may, at our discretion, ask bidders to supply us with a government-issued photo ID, the name and address of which match the registration name and address on the buyer's profile page.
We has the right to modify or re-start any bid for any reason. Should a lot on which you are bidding be modified or discontinued, you agree to hold our company and its officers harmless from any legal action.
We reserve the right to remove any lot from our auction, modify descriptions, or make any changes to auction at any time. we may for any reason and at any time refuse to process a bid, restrict bidding, or block a bidder. We have the right to reject any bid. We reserves the right to withdraw any item and to re-offer the item at another time. All users of this site agree to hold our company completely blameless for any of the above.
We do our best to describe the item's material, age and conditions. Our written descriptions are only our opinion and should in no way be interpreted as a fact nor a guarantee of any kind as to authenticity, age, period, source, origin, condition and material and to determine its condition, size, and whether or not it has been repaired or restored. We are not responsible or liable for the correctness or completeness of the descriptions, and we do not scientifically test woods, precious metals, ceramics or any other material for age, species etc. Any condition statement is given as a courtesy to our client, is only an opinion and should not be treated as a statement of fact. We shall have no responsibilities for any errors or omissions. All items are sold "AS IS" with no guarantees or warranties stated or implied. No returns can be made for a full or partial refund. No statements shall be deemed as warranty, representation or an assumption of liability; We may describe the damages, repairs, restorations or other defects for certain items, does not mean that all defects to such items are described or that similar conditions do not exist with respect to other items although not noted. Absence of a condition report does not imply that the item is without defect or damage.
Sale of Protected Animals and Plants.
Please note that the sale, importing and shipping of goods containing materials made from endangered species is strictly regulated by international, national, and state laws. This includes, but not limited to ivory, coral and tortoise shell. Please check with relevant import and customs regulations prior to bidding. Much of this policy can be found at these sites: www.fws.gov/international, http://www.dec.ny.gov/animals/7181.html, and http://www.cites.org. The laws are complex and change often. In addition, state laws may differ. It is the responsibility of the purchaser to be aware of the regulations that are in place in the locality where the purchaser resides and a transaction occurs.
Payment Policy.
Payment will be made immediately and will constitute the total purchase price of the high bid plus any associated transaction fees. Payment must be made in a manner acceptable to the Seller. Lots will not be shipped until good payment has been made. We reserve the right to hold merchandise until payment clears.
Payment is due immediately after the auction closed. We accept checks, money orders, bank wire transfers (in U.S. currency) and all major credit cards payment through PayPal. If make payment by PayPal, there is a fee of 3.5% for domestic and 4.5% for international buyers. There are no extra fees for payments made by checks and money orders. For wire transfers, please add a fee of $12 for domestic and $30 for international wires.
For international customers, please note that no checks or money orders drawn on foreign banks will be accepted; please remit payment by Bank Wire Transfer (please add a fee of $30 for international wire) or PayPal only (4.5% fee for international buyers).
If payments are not received within 7 days in spite of communications and attempts to receive payments, we may choose to cancel the sale and reoffer the lot. Late payments will be subject to additional fees. Failure to pay will result in legal action and you will be held liable for complete payment and any additional legal fees and expenses.
Shipping Policy.
All items must be paid in full and payment cleared prior to shipping. Normal packing and shipping time is within 7 days from the date your payment is received. We need 10 days to clear the check before we can ship out your package. You will be notified via e-mail with tracking number as soon as your package ships. The shipping and handling charges include full insurance and signature confirmation service.
Shipping will be made by domestic (USPS, FedEx or UPS) or international mail (USPS) services. PLEASE BE NOTED: MAIL ONLY, NO PICKUPS IN PERSON!!
