TERMS AND CONDITIONS By registering to bid on this auction you agree to the following terms and conditions. 1) Shipping and Payment: Payment is due in Ten (10) business days after the ending of each auction sale. We keep the right to hold sold lots until payment clears. Telephone and absentee bidders will be notified by e-mail within two working days of the sale end. We accept payment in the form of cash (up to 8000? or the equivalent amount in USD or EUR); wire transfer (no extra charges); Visa and Master Card (subject of 3% extra charge); Paypal - + 5% (for orders up to 2000$). We offer Worldwide in-house packing and shipping at discounted rates. Shipping costs will be added automatically to your invoice after the sale. We offer quick and efficient shipping to the USA and mainland China. We ship the items within 5 working days of receiving payment. This period may be longer around Christmas and other Bank holidays. 2) Amendments and Rights. We reserve the right, exercisable in our sole discretion, to change, modify, add to, subtract from, or otherwise amend the terms and conditions of this Agreement at any time. Except as otherwise stated below, all changes, modifications, or other amendments shall be effective on a prospective basis once they are posted on our Sites. This Agreement may not otherwise be amended except in a writing signed by you and Invaluable. Continued use of the Services by you constitutes your binding acceptance of this Agreement, including any changes or modifications made by us as described above. You agree to review the terms and conditions of this Agreement periodically to become aware of such revisions and to review your compliance with them. If at any time the terms and conditions of this Agreement are no longer acceptable to you, you must immediately cease all use of the Services. The right to access and use the Services is personal to you and is not transferable to any other person or entity. We reserve the right to update these Terms from time to time at our discretion. We will provide a report on the physical condition of any Lot on request. The content of a report is information only and should not be relied upon as advice. The Seller agrees that we shall be entitled to photograph or illustrate any Lot submitted for sale and to use such photographs or illustrations and any photographs, illustrations or documents provided by the Seller at any time and at our absolute discretion (whether or not in connection with any Auction). We reserve the absolute right to withdraw any Lot from sale for any reason. Nothing in these Terms shall limit or exclude our liability for (a) death or personal injury resulting from our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by English law. 3) Warranties All lots are sold "AS IS" and without recourse and neither Asiatica Art Auctions, nor its consignor makes any warranties or representations, express or implied, with respect to such lots. Prospective buyers are strongly advised to examine personally any property in which they are interested, before the auction takes place, to determine its condition and whether or not it has been repaired or restored or meets their expectations. Except as otherwise expressly and specifically provided in the Terms of Guarantee, neither Asiatica Art Auctions nor its consignor makes any express or implied warranty or representation of any kind or nature with respect to merchantability, fitness for purpose, correctness of the catalogue or other description of the physical condition, size, quality, rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, source, origin, exhibitions, literature or historical significance of any lot sold. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging; nor does a reference to particular defects imply the absence of others. References in the catalogue entry or the condition report to damage or restoration are for guidance only and should be evaluated by personal inspection by the bidder or a knowledgeable representative. The Terms of Guarantee are controlling, and no statement, whether written or oral, and whether made in this catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, the remarks of an auctioneer, or otherwise, shall be deemed to create any warranty, representation or assumption of liability. All statements by Asiatica Art Auctions in the catalogue entry for the property or in the condition report, or made orally or in writing elsewhere, are statements of opinion and are not to be relied on as statements of fact. Buyers are responsible for satisfying themselves concerning the condition of the property and the matters referred to in the catalogue entry. Asiatica Art Auctions its consignor make no warranty or representation, express or implied, that the purchaser will acquire any copyright or reproduction rights to any lot sold. 4) Bidding Bidding will begin at a price appropriate in auctioneer's discretion. This price can equal the reserve or be under it. If the lot has a reserve price and it is not met, the auctioneer has the right to withdraw the item from the sale. Once we declare that an item is sold, we cannot reopen the bidding. It is the bidder's responsibility to place a bid in good timing. When the auctioneer declares the item as sold, the title of property transfers to the successful bidder. We reserve the right to reject any bids deemed inappropriate or to withdraw any item(s) for lack of appropriate bids. If an item is withdrawn from the auction, it will be offered again only at the auctioneer’s discretion. All absentee and telephone bidders are required to sign and agree to these terms and conditions and may be asked to submitted a deposit; refundable in 7 days after the auction ends. All Phone bidding and Absentee Bidder's Form are held in the strictest confidence and must be received before the auction date. Bidding on an item indicates your understanding and acceptance of these Terms of Sale. If a purchaser breaches any of these Terms of Sale, including the obligation to pay for purchased items, Asiatica Art Auctions will cancel and re-offer the lot for sale. A buyer's premium will be applied to the purchase price of all items. It will be specified in the description of every sale. All items not picked up within Three months shall be assessed a storage fee of $10.00 per day, per item. 5) CITES Please note that lots containing ivory, tortoiseshell, or other animal materials may be subject to regulations imposed by the UK government. Some countries prohibit the importation of property containing materials from endangered species, and prospective purchasers should familiarize themselves with relevant customs regulations prior to bidding if they intend to import these lots into another country. Buyer is responsible for any and all CITES permits. 6) Photography and Copyrights All photos and descriptions posted on any online platform are the property of Asiatica Art Auctions and are subject to US copyright laws. No photo or description may be used without the advanced written approval of an authorized Babylon Auction agent. Use of unauthorized photos and descriptions may incur penalties. General: Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. Asiatica Art Auctions shall have no responsibility for any error or omission. The absence of any reference to condition or the reference to particular defects of any lot does not imply the absence of imperfections effects of aging or other defects. All clients are responsible for reviewing and accepting the Terms of Sale prior to bidding. All measurements are approximate. All items sold as is. If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect. These Terms shall be governed by and construed in accordance with the law of England and Wales, and you agree to submit to the exclusive jurisdiction of the English Courts.
