The following Conditions of Sale and Terms of Guarantee are Traiser Artise and the Consignor's entire agreement with the purchaser relative to the property listed in this catalog. The Conditions of Sale, Terms of Guarantee, the glossary, if any, and all other contents of this catalog are subject to amendment by us by the posting of notices or by oral announcements made before the sale. By participating in any sale through Traiser Artise, you acknowledge that you are bound by these terms and conditions while bidding and buying through our sale: AS-IS Goods auctioned are sold AS IS without any representations or warranties by the Consignor or us as to merchantability, fitness for a particular purpose, the correctness of the catalog or other description of the physical condition, size, quality, rarity, importance, medium, provenance, exhibitions, literature or historical relevance of any property and no statement anywhere, whether oral or written, whether made in the catalog, an advertisement, a bill of sale, a salesroom posting or announcement, or elsewhere, shall be deemed such a warranty, representation or assumption of liability. The Consignor and we make no representations and warranties, express or implied, as to whether the purchaser acquires any copyrights, including but not limited to, any reproduction rights in any property. The Consignor and we are not responsible for errors and omissions in the catalog, glossary, or any supplemental material. While we seek to describe lots accurately, it may be impractical for us to carry out exhaustive due diligence on each Lot. Prospective buyers are given ample opportunities to view and inspect before any sale, and they (and any independent experts on their behalf) must satisfy themselves as to the accuracy of any description applied to a lot. Prospective buyers also bid on the understanding that, inevitably, representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price involve matters of opinion. INSPECTION Prospective bidders should inspect the property before bidding to determine its condition, size, and whether or not it has been repaired or restored, or request additional photographs before bidding. WITHDRAWAL We reserve the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal. PER LOT Unless otherwise announced, all bids are per Lot as numbered in the catalog. PAYMENT Winning bidders are required to pay for won auction lots within five business days of the end of the sale, or make previously agreed-upon financial arrangements with our accounting department. NON PAYMENT By bidding on our lots in this auction, you agree that in the event of your nonpayment, we the auctioneer have the right to share your data including your name, address, contact information, IP address, and all other relevant data related to you and your failure to pay for your won lots with Live Auctioneers and all selling partners on Live Auctioneers in regards to your status of nonpayment and any other practices that are against the user agreement of Live Auctioneers. If we must pursue legal action to remedy payment, you the bidder agree to pay for all Traiser Artise and their assigns and successors legal costs associated with the pursuit of such payment from you. Additionally, we may also: (a) to proceed against you for damages for breach of contract; (b) to rescind the sale of that Lot and any other Lots sold by us to you; (c) to resell the Lot (by auction or private treaty) in which case you shall be responsible for any resulting deficiency in the total amount due (after crediting any part payment and adding any resale costs). Any surplus so arising shall belong to the seller; PARTIAL REFUNDS We do not provide partial refunds for any purchase under any circumstances. Items are sold as-is as pictured, and the images are included as part of the description. The price you agree to pay is the final price of the article, not including customs charges, shipping fees, and other costs associated with the facilitation of any transaction with us. TITLE AND COLLECTION OF PURCHASES The ownership of any Lots purchased shall not pass to you until you have made payment in full to us of the total amount due. (a) You shall at your own risk and expense take away any lots that you have purchased and paid for following within 35 days after the auction or upon the clearance of any check, or wire transfer used for payment after which you shall be responsible for any removal, storage, and insurance charges. (b) No purchase can be claimed or removed until it has been paid for. (c) Traiser Artise accommodates packing and shipping for this sales won lots; as such, the cost of packaging and shipping depends on the size/weight of the item(s) purchased, insurance requirements, and the shipping destination, not on the value of the item(s) purchased. Please note that any items not collected within 35 days of the sale date may be automatically removed to commercial storage and subject to a storage charge unless such an arrangement is made with us in writing. REMEDIES FOR NONPAYMENT OR FAILURE TO COLLECT PURCHASES If any Lot is not paid for in full and taken away in accordance with these Conditions or if there is any other breach of these Conditions, we, as agent for the seller and on our own behalf, shall at our absolute discretion and without prejudice, to any other rights we may have, be entitled to exercise one or more of the following rights and remedies: (d) to remove, store and insure the Lot at your expense and, in the case of storage, either at our premises or elsewhere; (e) to charge interest at a rate not exceeding 5% per month on the total amount due to the extent it remains unpaid for more than three working days after the sale; (f) to retain that or any other Lot sold to you until you pay the total amount due; (g) to reject or ignore bids from you or your agent at future auctions or to impose conditions before any such bids shall be accepted; (h) to apply any proceeds of the sale of other Lots due or in future becoming due to you towards the settlement of the total amount due and to exercise a lien (that is a right to retain possession of) any of your property in our possession for any purpose until the debt due is satisfied. (i) We shall, as agent for the seller and on our own behalf pursue these rights and remedies only so far as is reasonable to make appropriate recovery in respect of breach of these conditions THIRD-PARTY LIABILITY All members of the public on our premises are there at their own risk and must note the lay-out of the accommodation and security arrangements. Accordingly, neither the auctioneer nor our employees or agents shall incur liability for death or personal injury (except as required by law by reason of our negligence) or similarly for the safety of the property of persons visiting prior to or at a sale. SHIPPING All Shipping is handled by us in house at the buyer's expense. There is no local pickup option for this sale. We will include a charge for shipping that includes the cost of postage through Fedex, UPS, or USPS, along with the cost of insurance for the value of your item and signature confirmation. All international bidders are responsible for customs charges, and all shipments must include global door-to-door tracking. In the event of third party shippers, we are not responsible for any damaged or lost property that is relayed through a third-party shipping service. Once accepted by your third party shipping service, your third party shipping service assumes full custody and responsibility for the delivery of your item. We have experienced staff that has been packing and shipping arts and antiques for 20 years. We use bubble wrap; items may be double boxes and property secured for global shipping. If you have any shipping requirements, please alter us to your needs prior to payment, and we will do our best to accommodate your request. PROOF OF IDENTITY We may require proof of identification prior to acceptance of your bidding eligibility and registry, depending on your bidding profile. WIRE PAYMENTS Payment via wire transfer arrangements may be made over a TDB determined amount in certain instances. BID RESTRICTIONS Once an auction lot is won, we are not able to provide additional information or images on a lot regardless of if the request is placed by the winning bidder or otherwise. IMAGE USAGE The images provided by Traiser Artise on this site may not be used without the express permission of Traiser Artise. Any commercial use of these images, beyond the live auctioneer's platform without the express permission of Traiser Artise may be subjected to fines and legal action. PLEASE NOTE: THERE ARE NO RETURNS QUESTIONS FOR ITEMS IN THIS AUCTION FOR ANY REASON, INCLUDING RETURN REQUESTS RELATED TO CONDITION AND DESCRIPTION. ITEMS ARE SOLD AS IS-AS PICTURED. IF ADDITIONAL IMAGES ARE NEEDED, WE WILL DO OUR BEST TO ACCOMMODATE ANY REASONABLE REQUESTS PRIOR TO THE END OF THE AUCTION.
