4-Bidders are required to register prior to sale and must use the provided bidder number if provided.

5-The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of any dispute between bidders, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer or resell the item in dispute.

6-On the fall of the auction hammer, sale will be passed to the highest bidder acknowledged by the auctioneer, subject to the fulfillment by such bidder of all the conditions set forth herein, and bidder assumed full risk and responsibility and will pay the full purchase price. Invoices are subject to audit for error and bidder is responsible for paying any balances due therein.

7-All articles are to be removed within 10 days after sale. Any item not removed will be stored by Rock Vision 60' Inc. Fees will be charged accordingly.

8-We are not responsible for the acts or omissions of carriers or packers of purchased lots, whether or not recommended by us. Packing or handling of purchased lots by us is at the risk of the purchaser. In no event will we be liable for damages to glass or frames regardless of cause.

9-We reserve the right to withdraw any property prior to sale.

10-This is a privately owned and operated sale. We reserve the right to refuse admission to any person. No children will be allowed at the sale.

11-If any applicable conditions herein are not complied with by the purchaser, in addition to other remedies available to us and the consignor by law, including without limitation the right to hold purchaser responsible for the total purchase price, we may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property at public auction with out reserve.

12-Rock Vision 60' Inc is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Rock Vision 60' Inc or anyone else if the Internet service fails to work correctly before or during the live auction. Rock Vision 60' Inc will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Rock Vision 60' Inc reserves the right to withdraw or re-catalog items in this auction.

13-Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Rock Vision 60' Inc shall endeavor to describe in detail each item and any pertinent information at Rock Vision 60' Inc will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.

14- The items sold are often of considerable age and will exhibit wear, usage and damage often NOT LISTED IN THE DESCRIPTION. The absence of condition remarks in the description DOES NOT mean the item is in perfect condition. Please note that Rock Vision 60' Inc is pleased to provide our opinion of the condition of items offered for sale upon request. This service is provided for guidance only, without legal obligation. All lots are sold AS IS and there will be NO RETURNS BASED ON CONDITION. Subsequently, if a prospective buyer has not examined the property to their satisfaction before the sale, or his/her agent has not inspected the property, Rock Vision 60' Inc RECOMMENDS THAT THEY NOT BID ON THE PROPERTY. Again, prospective buyers are in ALL CASES responsible for determining the physical condition of lots as there are NO RETURNS based on condition.
