Walnut Tree Auction House Terms & Conditions Please read the following “Terms of Sale” carefully. These terms are applicable to all Online bidders and mail/email Postal bidders in this auction. Your submission of all bids in this Auction constitutes your full acceptance of these “Terms of Sale”. All registration information the Bidder provides to Auctioneer shall be current, complete, and accurate. Bidders must be 18 years of age or older. Bidder agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of or any transaction being conducted on and during the auction sale. 1. This is a live Online public auction, NOT an approval sale. At the live Online Auctions representation of a Sold icon, all sales are then final, all items are sold as is, where is, with all faults. and any bid acknowledged and relied on by the automated system shall not be withdrawn. No statement written or oral made by the auctioneer shall be deemed a warranty or assumption of liability by Walnut Tree Auction House or by any seller represented by Walnut Tree Auction House. 2. Bidding will begin at a price appropriate in auctioneer’s discretion, at the auctioneer’s discretion, no bid of less than one half the low estimate will be accepted from any source: phone bidding, absentee bidding, online bidding. Auction payments must be made in full at the conclusion of the sale. Absolutely No lots will be released until payment in full has been made. Payment may be made in Cash, by Personal Cheques (with proper identification, at the discretion of International Auction Galleries), or by Bank Transfer or Major Credit Cards as stipulated. Successful bidders will be notified by either email or mail via an auction receipt. 3. A 26% buyer's premium will be added to the hammer price of each lot for bidders. 4. All Online bidders must to complete a valid registration, with any identification as required by Walnut Tree Auction House. all Online bidders must accept the Terms and Conditions of Sale as set out here to be considered a valid bidder. We recommend Internet bidders register at least 48 hours prior to an auction to give enough time to process and approve the registration. It is important to note that we make no guarantees that new online bidders who register within 24 hours of the sale will be approved for bidding. Walnut Tree Auction House will not accept liability for any bids missed due to clerking issues, operator error, equipment failure, connection delays, communication lapses, or technical malfunctions of any nature. 5. Export and Permits: It is the purchaser’s sole responsibility to identify and obtain any necessary export, import, firearm, endangered species or other permit for the lot. Any symbols or notices in the sale catalogue reflect Walnut Tree Auctions’ reasonable opinion at the time of cataloguing and are for bidders’ general guidance only; Walnut Tree Auctions and the Consignor makes no representations or warranties as to whether any lot is or is not subject to export or import restrictions or any embargoes. 6. Shipping is primarily handled by multiple third-party shippers. When a client has won an item, shippers will be notified and will contact clients with quotes. Property will not be released without the buyer's written consent. Buyer is responsible for the cost of packaging and shipping. Shipping handled by Walnut Tree will be at the entire risk of the purchaser and Walnut Tree Auctions will have no liability of any loss of damage to such items. If for any reason a purchased lot cannot be delivered in the same condition as at the time of sale, or should any purchased lot be stolen, miss-delivered or lost prior to delivery, Walnut Tree shall not be liable for any amount in excess of that paid by the purchaser. 7. If we do not receive payment in full, in good cleared funds, within seven (7) business days following the sale, we are entitled in our absolute discretion to exercise one or more of the following measures, in addition to any additional actions available to us by law: a) To charge interest at such rate as we shall reasonably select; b) To hold the defaulting buyer liable for the total amount due and to commence legal proceedings for its recovery together with interest, legal fees and costs to the fullest extent permitted under applicable law; c) to cancel the sale d) to resell the property publicly or privately with such terms as we find appropriate, to resell the property at public auction without reserve, and with the purchaser liable for any deficiency, cost, including handling charges, the expenses of both sales, our commission on both sales at our regular rate, all other charges due hereunder and incidental damages. In addition, a defaulting purchaser will be deemed to have granted us a security interest in, and we may retain as collateral security for such purchaser’s obligations to us, any property in our possession owned by such purchaser. At our option, payment will not be deemed to have been made in full until we have collected funds represented by checks, or in the case of bank or cashier’s checks, we have confirmed their authenticity. e) To reject at any future auction any bids made by or on behalf of the buyer or to require a deposit from the buyer before accepting any bids; 8. The rights and obligations of the parties with respect to these Conditions of Sale, the conduct of the auction and any matters connected with any of the foregoing shall be governed and interpreted by the laws of the jurisdiction in California. If any part of these Conditions of Sale is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the conditions shall continue to be valid to the fullest extent permitted by law. Discretion Any and all of the conditions may be waived or modified in the sole discretion of Walnut Tree Auction House.
