TERMS AND CONDITIONS OF SALE
1.ALL PROPERTIES SOLD “AS IS”. ALL SALES ARE FINAL. NO RETURNS. NO EXCEPTIONS.
2.It is the responsibility of the prospective buyer to inquire as to the condition of a specific lot before bidding. United Pacific Auction(hereinafter referred to as “UPA”, “Auctioneer”, “we” & “us”) has included multiple photographs with most lots to show general condition. Please review all of the information and photographs before requesting additional information. You are advised to make your requests well in advance of the auction in order to receive the information in a timely manner. Or you can send email to upgauction@gmail.com. Requests made on the day of the sale may or may not be answered due to time constraints. All requests will be answered in the order received. Condition reports will not be given over the telephone under any circumstances.
3.A buyer’s premium to be added to the hammer price of each lot for floor , absentee, online and phone bidder.
Buyer’s Premium Rates
20% on the first USD 200,000 of the Hammer Price.
18% from 200,001 & above of the Hammer Price.
4. A range of estimates is given on each lot with a low and a high estimate. Estimates should not be relied on as a prediction of the actual selling price.
5. All items are sold “As is”and neither UPA nor the Consignor makes any warranties or representations of Merchant ability, of fitness, nor of any other kind, express or implied. All items are available for your examination prior to bidding. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to authenticity, provenance, age, condition, materials or any other feature of items being sold. UPA attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. We recommend prospective bidders examine all items in which they have an interest. By placing a bid, either in person, by phone, absentee or via the Internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you have an expert examine the lot for you or do not bid on the item in question.
All of the item’s measurements are approximate.
8.UPA reserves the right to withdraw any lot at any time before the auction without liability.
9.UPA reserves the right to reject any bid not commensurate with the value of the property offered.
10.UPA reserves the right to reject a bid from any bidder. The highest bid acknowledged by UPA shall be the buyer. In the event of any dispute between bidders, UPA shall have the sole and final discretion either to determine the successful bidder, or to re-offer and re-sell the article in dispute.
11.On the fall of the Auctioneer's hammer, title to the offered lot passes to the highest bidder who thereupon will pay the full purchase price therefore or the amount from the invoice. All property shall be removed by the purchaser at his expense on the day of sale and, if not so removed, may be sent by Auctioneer to a public warehouse for the account, risk and expense of the purchaser. Any damage to or loss of any item purchased which is left from Auctioneer after the day of purchase is the purchaser's sole responsibility. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to the Auctioneer and the Consignor by law, including without limitation the right to hold the purchaser liable for the bid price, the Auctioneer at its option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser, or (b) re-sell the property on 3 days notice to the purchaser and for the account and risk of the purchaser, either publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs, including warehousing, the expenses of both sales, and Auctioneer’s premium at its regular rates and all other charges due hereunder, and incidental charges. No claims shall be allowed after removal of goods and no article shall be re-sold for purchaser at the sale where purchased.?
12.ALL purchase (including buyer’s premium)will be subjected to the State of California Sales Tax of 9.5% unless 1) the buyer is the resident of out of State and merchandises are being shipped out of California, Or 2) the buyer has valid resale certificate or sale permit.
13.PAYMENT: Invoices for auctions are sent at the end of the sale (=1st invoice), which must be settled within 7 days. Shipping fees must be paid also within 7 days after you have settled the 1st invoice and got the shipping cost details from UPA if you would like us to arrange shipment on behalf of you. We may open a dispute if payment is not promptly remitted.We can only accept the bidder's payment by Paypal. For Wire Money Transfer , pls contact us at upgauction@gmail.com for the procedure before proceed. We do not accept international credit cards from international buyers.The payment/funds must be approval/received before the shipment.
14. All items are insured (if any) for the full purchase amount less carrier shipping charges, or the maximum amount allowed by the carrier and/ or country of destination. Insurance cost is the responsibility of the buyer and which is not included in the specific shipping amount listed in the item description.
15.Buyer need to bear and responsible to any import tax (if any) of the country if any.
16.Shipping (if any) is Buyer pay the actual shipping cost, and handling fee.All shipping costs will be quoted as we do most of our sale . International bidders are subjected to higher shipping fees. Please inquire about shipping to a particular country before start of the auction. All items are professionally packed by us using bubble wrap & foam. We ship at every business day from Monday to Friday to ensure prompt delivery. A 7-days free pick up is offer, courtesy to all UPA clients. After 7-days, UPA will charge USD 5 per lot , per day , unless the buyer and UPA have prior arrangement.
