拍賣規則(中文終極版)
第一條 定義
在本規則中,除非另有說明,下列術語具有如下含義:
1. “本公司”指華岳國際拍賣(香港)有限公司;
2. “競買人”指經本公司審核並取得競拍資格的自然人或法人;
3. “買受人”指最終競得拍賣標的的競買人;
4. “拍賣標的”指在拍賣活動中公開出售的物品;
5. “落槌價”指拍賣師落槌確認成交時的價格;
6. “傭金”指買受人應向本公司支付的服務費用。
第二條 適用範圍
本規則適用於本公司舉辦的所有拍賣活動。凡參與本公司拍賣活動的各方,均視為已充分閱讀、理解並同意遵守本規則及相關拍賣須知。
第三條 法律與合規
1. 本公司不對涉及禁止出境的文物或拍賣標的作特別標識。
2. 競買人應自行確認拍賣標的是否符合相關法律法規及進出口要求。
3. 如涉及文物出境,買受人須依法自行辦理相關審批手續。
4. 因未履行合規義務產生的風險與責任,由買受人自行承擔。
第四條 拍品狀態與免責
1. 所有拍賣標的均以“現狀”進行拍賣。
2. 本公司對拍賣標的的真偽、年代、作者、材質、品質、來源及價值不作任何明示或默示保證。
3. 本公司不承擔任何形式的瑕疵擔保責任。
4. 競買人應在競拍前自行審慎判斷拍品狀況並承擔相應風險。
第五條 競拍規則
1. 競買人須完成註冊及保證金繳納後方可參與競拍。
2. 競買人一經出價,即視為不可撤回。
3. 本公司有權拒絕任何出價或取消競買資格。
4. 拍賣師對拍賣過程擁有最終裁量權。
第六條 成交與付款
1. 拍賣標的以落槌為成交標誌。
2. 買受人須在規定期限內支付全部款項,包括:
* 落槌價
* 傭金
* 稅費及其他相關費用(如有)
3. 所有款項須按照本公司指定方式支付。
第七條 風險與所有權轉移
1. 拍賣標的自落槌成交之時起,其風險即轉移至買受人。
2. 在買受人未付清全部款項前,拍賣標的所有權仍歸本公司或委託人所有。
第八條 違約責任
如買受人未按期履行付款義務,本公司有權:
1. 扣除全部保證金;
2. 解除成交;
3. 重新拍賣該拍賣標的;
4. 向買受人追償再次拍賣差價、傭金損失及相關費用;
5. 限制其參與本公司後續拍賣活動。
第九條 保證金制度
9.1 繳納
保證金為競買人參與拍賣前繳納的履約擔保資金,具體金額及繳納方式以拍賣公告或系統顯示為准。
9.2 退還
在符合以下條件時,保證金將原路無息退還:
1. 未競得拍品;
2. 已競得拍品並按時足額付款;
3. 交易未完成或被取消。
退還時間為拍賣結束後1–15個工作日內。
9.3 扣除
如買受人違約未付款,保證金將被全部扣除。
9.4 抵扣
保證金可自動抵扣拍品款項:
* 不足部分由買受人補足;
* 多餘部分無息退還。
第十條 發票
1. 買受人須於結清款項當月內申請開具發票;
2. 發票抬頭須與買受人名稱一致;
3. 發票一經開具,不得更改或重開。
第十一條 包裝、運輸與出境
1. 拍賣標的之包裝、運輸及保險由買受人自行承擔風險及費用;
2. 本公司可提供協助,但不承擔相關責任;
3. 涉及文物出境的,由買受人自行辦理相關手續。
第十二條 不可抗力
因不可抗力導致拍賣無法進行或交易無法履行的,本公司不承擔責任。
第十三條 爭議解決
本規則適用香港特別行政區法律。因本規則產生的爭議,提交香港有管轄權的法院或仲裁機構解決。
第十四條 最終解釋權
本規則的最終解釋權歸本公司所有。

Auction Terms & Conditions (Final English Version)
1. Definitions
In these Terms and Conditions:
1. “Company” means Huayue International Auction (Hong Kong) Limited;
2. “Bidder” means any individual or entity approved to participate in the auction;
3. “Buyer” means the successful Bidder;
4. “Lot” means any item offered for sale;
5. “Hammer Price” means the final bid accepted by the auctioneer;
6. “Buyer’s Premium” means the commission payable by the Buyer.
2. Scope
These Terms apply to all auctions conducted by the Company. Participation in any auction constitutes full acceptance of these Terms.
3. Legal Compliance
1. The Company does not identify Lots subject to export restrictions.
2. Bidders are responsible for ensuring compliance with all applicable laws and regulations.
3. Buyers shall obtain all necessary export permits at their own expense.
4. All risks arising from non-compliance shall be borne by the Buyer.
4. Condition & Disclaimer
1. All Lots are sold “as is”.
2. The Company makes no warranties as to authenticity, age, attribution, condition, provenance, or value.
3. No warranty of any kind is provided.
4. Buyers must rely on their own judgment before bidding.
5. Bidding
1. Bidders must complete registration and deposit payment prior to bidding.
2. All bids are irrevocable once submitted.
3. The Company reserves the right to refuse any bid.
4. The auctioneer has absolute discretion over the bidding process.
6. Sale & Payment
1. The fall of the hammer constitutes a binding sale.
2. The Buyer must pay within the specified period:
* Hammer Price
* Buyer’s Premium
* Applicable taxes and fees
3.Payments must be made in accordance with the Company’s instructions.
7. Risk & Title
1. Risk passes to the Buyer upon the fall of the hammer.
2. Title shall not pass until full payment is received.
8. Default
If the Buyer fails to pay:
1. The deposit may be forfeited;
2. The sale may be cancelled;
3. The Lot may be resold;
4. The Buyer shall be liable for any deficiency and costs;
5. Future bidding privileges may be restricted.
9. Deposit
9.1 Payment
The deposit serves as a guarantee of performance and shall be paid as required.
9.2 Refund
Deposits will be refunded (without interest) if:
* No successful bid is made;
* Payment is completed in full;
* The transaction is cancelled.
Refunds are processed within 1–15 working days.
9.3 Forfeiture
Deposits shall be forfeited in the event of default.
9.4 Application
Deposits may be applied toward the purchase price. Any surplus will be refunded; any shortfall must be paid.
10. Invoice
Invoices must be requested within the same month of payment and cannot be amended once issued.
11. Shipping & Export
Shipping, insurance, and export procedures are the Buyer’s responsibility. The Company may assist but assumes no liability.
12. Force Majeure
The Company shall not be liable for failure due to force majeure events.
13. Governing Law
These Terms shall be governed by the laws of Hong Kong.
14. Final Interpretation
The Company reserves the right of final interpretation.
