Auction Conditions
Participation in the auction in person, in writing or by telephone, post-sale and over-the-counter sales means that the following conditions are recognized:
I. General
1. DE253236187, represented by the personally liable partner, the art and auction house Füsser and Daschmann Verwaltungs GmbH, Wiesbadener Strasse 61, 55252 Mainz-Kastel, District Court - Register court: Wiesbaden HRB 22707, VAT ID no. DE253236187, represented by the managing directors Alexandra Füsser and Reno Daschmann, (hereinafter referred to as the auction house) auctioned the items to be auctioned as an agent in the name of others and for the account of the consignor (hereinafter also referred to as the client), who remain unnamed, or in the official Assignment. At the request of the buyer (also known as the bidder), especially in the event of defects, the auction house will disclose the name of the client.
2. The auction house has an official license for auctions according to § 34b GewO. The auction is a public auction i. See §§ 474 Paragraph 2 Sentence 2, 312d Paragraph 2 No. 4 BGB. There is no right of revocation with regard to the purchase contract that comes into being at the auction in accordance with Section 156 of the German Civil Code (BGB).
3. General terms and conditions of the bidders do not apply without the auctioneer's express objection to the use of the general terms and conditions of the bidder being required.
II. Auction catalog, inspection, examination
1. The items to be auctioned are presented in advance by the auction house in an auction catalog. In this a catalog number is assigned to the individual items. In addition, the limit price set by the client for the respective item is specified.
2. All items to be auctioned can be viewed and checked prior to the auction during the opening hours and at the time set for the auction. The interested parties are liable for the damage they cause to the objects on display. The things are usually used. The catalog information provided to the best of our knowledge and belief does not constitute information on properties within the meaning of § 434 ff. BGB, quality or durability guarantees that become the subject matter of the contract.
3. The auction house is entitled to take items offered in the auction catalog out of the auction without stating reasons until they are accepted. This applies in particular in the event that a client withdraws an item from the auction. There is no entitlement to bid on an item presented in the auction catalog.
4. The auction house reserves the right to combine sales / lot numbers, to separate them, to offer them out of sequence, to withdraw them or to auction them under reserve. The sales / lot number is the number under which the items are called up in the auction, are listed in the auction catalog or are offered for sale over the counter.
5. The auction house is free to exclude bidders from participating in the auctions if there are doubts as to their creditworthiness or identity or if the bidder's place of residence or delivery address is in a country into which the offered item will not be imported allowed.
6. The auction house is free to request proof of creditworthiness from the bidder or to make the acceptance of a bid dependent on a deposit or a security line. In addition, the auction house can exclude a bidder from participating in the auction if the bidder has not yet paid for items that have already been purchased.
III. auction
1. Participation in the auction takes place through personal participation in the auction in the auction room of the auction house. Bids can also be submitted via the auction house's homepage, in writing, by telephone, by fax or e-mail as well as via the online platforms the-saleroom.com or lot-tissimo.
2. Each bidder must give his name and address before the start of the auction. This also applies if he participates in the auction as a representative. In this case, he must also provide the name and address of the person he is representing. In case of doubt, the bidder purchases in his own name and for his own account.
